Rental Agreement for Vacation Home
This Rental Agreement ("Agreement") is made between Kathy Corby (“Owner") and the Guest specified below, for the rental of the vacation home located at on Route 212, Saugerties, NY 12477 ("Property") for the period specified.
2. Payment Terms:
a. The Guest agrees to pay the total rental fee as detailed in the online rental agreement terms.
i. A deposit of one half of the total rent amount is due upon signing this Agreement.
ii. The remaining balance is due fourteen days before the Start Date.
3. Guest agrees to the following cancellation policy: Full refund for cancellations up to 14 days before check-in. If booked fewer than 14 days before check-in, full refund for cancellations made within 48 hours of booking. After that, 50% refund up to 7 days before check-in. No refund after that.
4.. Property Use and Restrictions:
a. The Property shall be used solely for vacation purposes by the Guest and the maximum occupancy shall not exceed 8 adult persons and up to four children. Up to four pets are permittted in the listing.
b. The Guest agrees to comply with all local laws, ordinances, and community rules.
c. Pets are allowed on the property as per the rental agreement. Pets must not be left unattended on the property for greater than 4 hours, and all waste must be disposed of in the bags provided, which are to be placed in the outdoor receptacle on the front landing. This must be emptied by the guest on departure and contents deposited in the trash receptacles near the road.
d. No smoking or illegal activities are permitted on the Property.
e. The following use agreements pertain not the hot tub on the property: The guests individually and separately must agree to latch and lock the cover with the key hanging on the hooks near the front door when not in use.
The hot tub cannot be used by more than 8 people at a time.
Do not sit on the cover, and do not take glass in or near the hot tub.
f. Garbage and recycling is to be placed in the dedicated containers near the road on departure.
g. Any furnishings that are moved must be replaced in their original positions.
h. The guest agrees to vacate the property by the specified check-out time.
5. Maintenance and Damages:
a. The Guest shall maintain the Property in good and clean condition and shall report any damages or maintenance issues to the Owner immediately. The owner agrees to remediate any deficiencies in the property as soon as possible and may offer partial or full refunds or the ability to cancel at her sole discretion.
b. The guest is encouraged to obtain travel insurance to cover costs in the case of last minute cancellation, etc.
c. Note that Guest may be held liable for damage caused to the property by illegal activities, or activities in violation of the above house rules.
d. Willful disregard of the above property use restrictions or illegal activities conducted on the property will result in summary termination of the rental agreement by Owner, with remedies up to and including eviction by law enforcement if required.
6. Liability and Indemnification:
a. The Owner shall not be liable for any accidents, injuries, or damages to the Guest or their property during their stay above the limits provided for in the Safely short term rental insurance policy.
b. The Guest agrees to indemnify and hold the Owner harmless from any claims, costs, or liabilities arising from their use of the Property.
7. Governing Law:
This Agreement shall be governed by and construed in accordance with the laws of the state of New York. Note that security cameras of the exterior of the property may be used to monitor activity on the property for the safety and security of both Guest and Owner. The Owner affirms that there are no cameras or digital monitoring devices in the interior of the property, in compliance with the laws of the State of New York.
